    We have experienced some challenges with the truck stop review forms on the app (on the Google Play Store). An article from CCJ opened this way:

"A truck driver has filed a class action lawsuit against CPC Logistics alleging the company violated the Fair Credit Reporting Act by not notifying applicants or employees they were not hired because of information found in their DAC reports."

The driver's DAC report supposedly contained "inaccurate and adverse work history information".

Furthermore, "The company failed to notify Hoeflicker within three business days, as the FCRA requires, following the 'adverse action.'"

Could the driver have prevented this?

It depends.

According to this article:

"DAC reports are regulated by the Fair Credit Reporting Act (FCRA), which entitles truckers to receive a free copy every year of the information that has been collected on them" and "it takes around 10-15 days from the day your request is submitted until the hard copy is delivered."

A quick decision to

  • leave a trucking company that left inaccurate info on a trucker's DAC report and
  • then apply to work for another trucking company

may not give the trucker enough time to see (let alone dispute and have corrected) any inaccuracy present.

HireRight.com allows you to:

HireRight.com states, "If you believe that any information in your background / file reports is inaccurate or incomplete, you may file a dispute with HireRight for free. The dispute investigation process generally may take up to 30 days, depending on the nature, scope and source of the information being disputed."

It's a good idea for truckers to request a copy of their DAC reports

  • for free once a year; and
  • whenever they are thinking of switching trucking companies (to make sure everything is accurate).

(It's a good idea to request your free credit report once a year, too.)

Because of inaccurate info on this one trucker's DAC report, he has lost out two ways:

  • the "lost employment opportunity" to work with the trucking company of his choice, the job of which he had been offered contingent upon the background report being OK; and
  • the cost of the legal action he is pursuing.

Personally, we're glad that the trucker is fighting this. But we're shocked that the trial is set to take place well over a year from now!

Since his DAC report is going to affect his ability to be hired by any trucking company, we wonder what this driver plans to do for income between now and then.

Prevent this situation by monitoring your background reports regularly. Dispute each and every inaccuracy until all of the info on your report is accurate.

Here is a round-up of some recent news regarding truckers and their income.

  • We know of a trucker who suddenly found himself out of his trucking job because the medical examiner refused to re-certify him as a result of a finding during his DOT physical.

  • The trucker whose situation is listed in "Prevent This!" above was unable to be hired by the trucking company of his choice because of inaccurate information in his DAC report.

  • In this article, the author made his "case for the $100,000 a year trucker".
    He further stated, "So in 40 years, the average income of a trucker has increased by 17%. In the same period of time, two of the most costly purchases a trucker will make in his/her lifetime ; a home and a car, have increased by 560% and 883% respectively."

  • New trucking rules in Australia will prevent "Owner-operator truck drivers" from "competing with bigger companies".

In the USA's deep south, spring has sprung (if not by the calendar, then definitely by the warmer temperatures and budding foliage)! People will be ramping up efforts to travel on vacations.
